અમદાવાદમાં સર્જાયેલા લઠ્ઠાકાંડના પગલે ગુજરાતના પ્રધાનમંડળે હાલના ‘મુંબઇ નશાબંધી (ગુજરાત સુધારા) કાયદામાં વધુ સુધારો કરીને દારૃ અને લઠ્ઠાના ગુનેગારોને ફાંસીની સજા કરવાની અભૂતપૂર્વ જોગવાઇ કરતું એક બિલ આજે મંજૂર કર્યું છે. આ બિલ વિધાનસભાના ચાલુ સત્રમાં જ સરકાર ચર્ચા માટે ગૃહમાં રજૂ કરનાર છે.

આજે મુખ્યમંત્રી નરેન્દ્ર મોદીની અધ્યક્ષતામાં મળેલી મંત્રીમંડળની બેઠકમાં લઠ્ઠાકાંડના મુદ્દે ચર્ચા કરવામાં આવી હતી અને મોદીની સૂચનાને પગલે કાયદા વિભાગે વર્તમાન નશાબંધી કાયદામાં રહેલી ક્ષતિઓ દૂર કરવા તેમજ સમગ્ર કાયદાને વધુ શક્તિશાળી બનાવવા માટે સુધારા વિધેયક તૈયાર કરાયું હતું તેની ચર્ચા વિચારણા કરીને મંજૂર કરવામાં આવ્યું હતું. સૂચિત બિલ હવે નશાબંધી કાયદા (ગુજરાત સુધારા) વિધેયક, ૨૦૦૯ તરીકે આજે વિધાનસભા સચિવાલયને ગૃહમાં દાખલ કરવા માટે મોકલી આપવામાં આવ્યું છે. સરકારનંુ માનવું છે કે અગાઉ ૧૯૯૭ સુધીમાં ૨૫ લઠ્ઠાકાંડમાં ૩૫૪ વ્યક્તિઓએ જાન ગુમાવ્યા છે અને ઘણા કિસ્સામાં તપાસ પંચ પછી પણ કોઇ નક્કર કાર્યવાહી થઇ ન હોવાથી હવે કાયદામાં પણ સુધારા કરી આકરી જોગવાઇ કરવી આવશ્યક જણાઇ છે. અગાઉ પણ મિથેનોલ જેવા કેમિકલથી બનાવાતા ઝેરી દેશી શરાબ પીવાથી આવા લઠ્ઠાકાંડ સર્જાયા હતા અને આજે પણ અમદાવાદમાં આ જ રીતે બનેલા લઠ્ઠાએ અનેક લોકોના જાન લીધા છે. સૂચિત બિલની જોગવાઇઓ મુજબ દારૃ અને લઠ્ઠાના ગુનેગારોને ફાંસીની સજાને પાત્ર થાય તેવા સુધારા કરવામાં આવ્યા છે. આની સાથોસાથ, નશાબંધીના કાનૂનના અમલ માટે નિષ્કાળજી દાખવનાર પોલીસ અધિકારીઓને પણ એક વર્ષ સુધીની જેલની સજા થાય તેવી આકરી જોગવાઇ પણ સૂચવાઇ છે. સમગ્ર દેશમાં લઠ્ઠા કે દારૃના ગુનેગારો સામે મૃત્યુ દંડ કે આજીવન કેદની સજા જેવા સખ્ત જોગવાઇવાળો કાયદો હાલ અસ્તીત્વમાં નથી. આ બિલમાં લઠ્ઠાની વ્યાખ્યા કરવામાં આવી છે. કલમ ૨૩ક પ્રમાણે લઠ્ઠો એટલે એવો બનાવટી દારૃ જેમાં, મિથેનોલ હોય અથવા માનવ શરીરને નુકસાનકારક અથવા હાનિકારક અસરો થાય તેવો અથવા જેનાથી વ્યક્તિનું મૃત્યુ નીપજે તેવો બીજો કોઇ પણ ઝેરી પદાર્થ હોય.

•ભૂતકાળમાં ૨૫ લઠ્ઠાકાંડમાં ૩૫૪ લોકોએ જાન ગુમાવ્યા છતાં નક્કર પગલાં લેવાયાં નથીઆ ઉપરાંત સન ૧૯૪૯ના મુંબઇના ૨૫મા અધિનિયમમાં નવી કલમ ૬૫-ક ઉમેરવા માટેની જોગવાઇ કરવામાં આવી છે અને આ જોગવાઇમાં જે કોઇ વ્યક્તિ એટલે કે લઠ્ઠાનું ઉત્પાદન કરતી હોય, દારૃ ગાળવાની ભઠ્ઠી અથવા દારૃ બનાવવાની ભઠ્ઠી માટેનું કોઇ બાંધકામ અથવા કોઇ કામ કરતી હોય, લઠ્ઠાનું વેચાણ કરતી હોય અથવા તેની ખરીદી કરતી હોય અથવા લઠ્ઠો વાપરતી હોય, રાખતી હોય, હેરફેર કરતી હોય અથવા પોતાના કબજામાં રાખતી હોય તેને દોષિત ઠર્યેથી, દસ વર્ષ સુધની, પરંતુ સાત વર્ષથી ઓછી ન હોય તેટલી મુદત સુધીની કેદની અને દંડની પણ શિક્ષા થશે. આમ, દારૃ બનાવનારા, દારૃની હેરફેર કરનારા, સંગ્રહ કરનારા, દારૃનું વેચાણ કરનારા અને લઠ્ઠાનો સંગ્રહ કરનારા ગુનેગારોને આકરી સજાની જોગવાઇ ઉમેરાશે.

કલમ ૬૫-કની પેટા કલમ (૧)માં ઉલ્લેખેલા લઠ્ઠાના ઉપયોગથી કોઇપણ વ્યક્તિનું મૃત્યુ નીપજે તો, જે વ્યક્તિએ લઠ્ઠાનું ઉત્પાદન કરેલુ હોય, રાખેલો હોય, તેનું વેચાણ કરેલું હોય અથવા તે પીવાની અથવા વિતરણની વ્યવસ્થા કરેલી હોય તેને, દોષિત ઠર્યેથી મૃત્યુ દંડ અથવા આજીવન કેદની અને દંડની શિક્ષાને પાત્ર થશે. આમ, બુટલેગર્સને હવે મૃત્યુ દંડથી આજીવન કેદની સજા થઇ શકશે. આ જ રીતે નવી કલમ ૯૪ ક દ્વારા સરકારે જે પોલીસ અધિકારીઓ અને નશાબંધી વિભાગના અધિકારીઓ આ કાયદાના અમલમાં નિષ્કળજી દાખવવા માટે જવાબદાર ઠરશે તેની સામે કાનૂની ગનો દાખલ કરીને તેઓ સામે કેસ પણ ચલાવાશે અને એક વર્ષ સુધીની જેલની સજાને પાત્ર ઠરાવાયા છે. એટલું જ નહીં કલમ ૯૮માં સુધારો કરીને સરકારે એવી પણ જોગવાઇ કરાઇ છે કે આવા અધિકારીઓ કોર્ટના આખરી ચુકાદા સુધી વાહનો, સાધનો વગેરેને બોન્ડ અથવા જામીન પર મુક્ત કરી શકાશે નહીં.

આ ઉપરાંત લઠ્ઠો કે દારૃ વગેરે નિયત કરેલી મર્યાદા ઉપરાંતના જથ્થાની હેરાફેરી, પરિવહન માટે વપરાશમાં લેવાના તમામ પ્રકારના વાહનો, સાધનો વગેરે સરકારી સંપત્તિ તરીકે જપ્ત કરી લેવાને પાત્ર બનશે. સૂચિત સુધારામાં આ પ્રકારે પકડાયેલા દારૃ, લઠ્ઠા વગેરેના નમૂના ફોરેન્સીક સાયન્સ લેબોરેટરીમાં મોકલવાનું ફરજિયાત બનશે.

સૂચિત સુધારા
•ગુનેગાર માટે આજીવન કેદથી મૃત્યુ દંડ સુધીની આકરી સજા
•દારૃ-લઠ્ઠો બનાવનાર, હેરાફેરી, સંગ્રહ, વેચાણ કરનારને દસ વર્ષ તેમજ આવો જથ્થો પૂરો પાડનાર બુટલેગર્સને આજીવન કેદથી મૃત્યુ દંડ સુધીની સજા.
•વાહનો, સાધનોને સરકારી મિલકત ગણીને જપ્ત કરાશે.

After BSNLEU got recognition, the VRS was got dropped. FR 22(i)(a)(i) has been restored in New Promotion Policy. Promotion Policy has been signed reducing the decades old discrimination between executives and non-executives.

The workers understand all these. And that is why despite the fact that NFTE & FNTO which both together got about 1,45,000 votes in the first verification have been reduced to 95,000 in the IV Verification and BSNLEU which got 90,000 in the first verification got 1,24,000 in the IV Verification defeating the formers alliance by more than 28,000 votes.

[15.07.2009] HOW FUNNY ! :- FNTO has put in its website a form asking workers to sign and submit it to management with regard to wage revision. In the letter it is stated that “Kindly award pay scales as recommended by second pay review committee.”

Second Pay Review Committee was appointed to recommend wage revision for executives only and it had no connection with the pay revision non-executives and not recommended any pay scales for non-executives. But interestingly FNTO is asking the workers to request the management to award pay scales recommended by the Committee !

BSNL had to pay Rs.1000 crore as extra interest - CAG Report

In what highlights mismanagement in government-run companies, BSNL failed to return a government loan of Rs. 7,500 crore when it had a disposable reserve of more than Rs. 18,000 crore. This resulted in the company paying an interest of over Rs. 1,000 crore.

The country's biggest telecom company parked its surplus funds in banks to earn an interest of 6% - 7% when it was already paying interest of 14.5% for the loan.

"BSNL failed to return government loan of Rs. 7,500 crore inspite of having adequate cash reserves of Rs. 18,829 crore as of March 2005 parked in bank deposits with average rate of return of 6.19% to 7.38% per annum against the rate of interest of 14.50% for the loan," a CAG report on BSNL tabled in Parliament on Monday said.

"This imprudent financial management resulted in excess expenditure of Rs. 1,089 crore on interest payment,” it added. [Source: The Times of India, dated 14.07.2009]

– CAG Report

Comptroller and Auditor General of India (CAG) has informed the Parliament on Monday that BSNL and MTNL lost Rs. 1,547.47 crore due to careless financial management and wasteful expenditure during the last financial year. CAG has alleged that BSNL has lost Rs.355.66 crore in loss or non-recovery or non-short billing. [10.07.2009] Utter Confusion ! They don’t know what they demand:- It is observed at FNTO (CHQ) website that they demanded to BSNL Management: “IDA Pay Scales of the non-executives w.e.f. 01.01.2007 in the same line and fixation formula adopted for executives without any periodicity.”

This actually means (apart from periodicity), they don’t want benefit of merger of 50% IDA, which has already been approved by DPE but not yet implemented for BSNL executives. Moreover, they want that non-executives pay scales be constructed in relation to present E-1 minimum pay of Rs.16,400/-, since proposed E-1 A pay scale has not yet been granted.

THEY MAY INSIST ON LOWER BENEFIT FOR NON-EXECUTIVES, BUT BSNLEU CAN’T COMPROMISE ON LONG TERM INTEREST OF THE EMPLOYEES.

In their memorandum supposed to be signed by employees, they demanded: “Kindly award pay scales as recommended by Second Pay Review Committee.”

What a joke indeed !

2nd Pay Review Committee was for executives and its recommendations confined to executives only. No pay scale for non-executives recommended by 2nd Pay Review Committee.

એક દૂરોગામી સુધારામાં આજે કેન્દ્ર સરકારે ધોરણ ૧૦ની બોર્ડની પરીક્ષાને વૈકલ્પિક બનાવવાની અને દેશભરમાં ધોરણ ૧૨ની પરીક્ષા એક જ બોર્ડ લે તેવી દરખાસ્ત મૂકી છે. દેશભરમાં ધોરણ ૧૨ની પરીક્ષા એક જ બોર્ડ લે તે માટે દેશભરમાં હાલમાં ધો.૧૨ની પરીક્ષા લેતાં સીબીએસઈ તથા સીઆઈએસસીઈ સહિતનાં ૩૩ બોર્ડને સ્થાને એક નવું જ બોર્ડ રચાશે. કેન્દ્રના આ પગલાંથી ધોરણ ૧૦ના વિદ્યાર્થીઓને ભારે રાહત થશે. આ ઉપરાંત કેન્દ્રની યુપીએ સરકારના પ્રથમ ૧૦૦ દિવસમાં આર્થિક રીતે નબળા વિદ્યાર્થીઓને પ્રોફેશનલ કોર્ષો માટે શૈક્ષણિક લોનો પર વ્યાજની સબસિડી આપવાની યોજના પણ અમલમાં મૂકવામાં આવશે.

કેન્દ્ર સરકારની દરખાસ્તઃ ધોરણ ૧૦ના બોર્ડને વૈકલ્પિક બનાવવાની પણ યોજના
કેન્દ્રીય માનવ સંશાધન પ્રધાન કપિલ સિબ્બલે ધોરણ ૧૦ની બોર્ડની પરીક્ષા રદ કરવાની પણ દરખાસ્ત મૂકી છે. તેમણે કહ્યું હતું કે પરીક્ષા આધારિત વ્યવસ્થાને કારણે વાલીઓ અને વિદ્યાર્થીઓને હેરાનગતિ થાય છે તેને કારણે પરીક્ષાઓ સિવાય પણ ગ્રેડ સિસ્ટમ જેવી વૈકલ્પિક સિસ્ટમ અમલમાં લાવી શકાય છે.

તેમના મતે દસમા ધોરણ પછી પણ વિદ્યાર્થીઓ તે જ સ્કૂલમાં ચાલુ રહેતા હોવાથી આવી બોર્ડની પરીક્ષાઓનો કોઇ અર્થ જ નથી. એચઆરડી મંત્રાલય આ મુદ્દે કોઇ પણ અંતિમ નિર્ણય લેતાં પહેલાં મસલત કરશે અને શિક્ષણ બોર્ડોને વિશ્વાસમાં લેશે. સ્કૂલો સાથે મસલત કરીને જ આ નિર્ણય લેવામાં આવશે.

૧૦માંની બોર્ડની પરીક્ષામાં નાપાસ થવાની બીકે પણ કેટલાક વિદ્યાર્થીઓ આત્મહત્યા કરી લે છે. આ પ્રકારની પરિસ્થિતિમાંથી તેમને બહાર લાવવાનો પણ અમારો પ્રયાસ છે તેમ જણાવતાં તેમણે માર્કની પદ્ધતિમાં ફેરફારની જરૃરિયાત પર ભાર મૂક્યો હતો.

આની જગ્યાએ કેન્દ્ર સરકાર માર્ક્સ આપવાની સમીક્ષા પ્રક્રિયાને બદલે ગ્રેડ્સ આપવાની વ્યવસ્થા અમલમાં મૂકશે. આનાથી વિદ્યાર્થીઓ અને વાલીઓ પરથી તાણ ઘટશે તેમ જણાવતાં તેમણે ઉમેર્યુ હતું કે સેન્ટ્રલ બોર્ડ ઓફ સેકન્ડરી એજ્યુકેશન (સીબીએસઇ) દેશમાં ગ્રેડિંગ સિસ્ટમ દાખલ કરતું પ્રથમ બોર્ડ હશે. આ અંગેની એક દરખાસ્ત અનિર્ણીત છે.

દેશના ૩૩ બોર્ડોની જગ્યાએ એકમાત્ર બોર્ડ રાખવાની અમારી નેમ છે તેમ જણાવતાં સિબ્બલે કહ્યું હતું કે કાયદાનો અભ્યાસ કરતી સંસ્થાઓમાં પ્રવેશ માટે સંયુક્ત કાયદા પ્રવેશ ટેસ્ટની પેટર્ન પર તમામ વિદ્યાર્થીઓ માટે એક જ પરીક્ષા રાખવાની દરખાસ્ત છે.

ભણતરની સારી ગુણવત્તા જાળવવા માટે સ્કૂલો માટે એક સ્વતંત્ર એક્રેડિયેશન સંસ્થાની સ્થાપનાની શક્યતા ચકાસશે. હાલમાં સ્કૂલો કોઇ પણ સંસ્થા સાથે એક્રીડિયેટ કરવામાં આવતી નથી તેમ જણાવતાં સિબ્બલે ઉમેર્યું હતું કે રાઇટ ઓફ ચિલ્ડ્રન ટૂ ફ્રી એન્ડ કમ્પલસરી એજ્યુકેશન બિલને ઘડવા માટે તમામ પગલાં લેવામાં આવશે. આ ખરડામાં છથી ૧૪ વર્ષના દરેક બાળકને શિક્ષણના મૂળભૂત હક્કોના સમાવેશની દરખાસ્ત છે.

વધુમાં સિબ્બલે કહ્યું હતું કે આ બિલ આ સેશનમાં પાસ થવું જોઇએ. જેથી કરીને તમામ બાળકને ફરજિયાત શિક્ષણનો હક્ક મળી જશે. આ ઉપરાંત સરકાર ઓલ ઇન્ડિયા મદરેસા બોર્ડ સ્થાપવા પણ ઇચ્છે છે. જે સીબીએસઇ અને અન્ય બોર્ડોની સમકક્ષ ડિગ્રીઓ ફાળવશે. બોર્ડ ર્ધાિમક શિક્ષણોમાં દરમિયાનગીરી કર્યા વગર મુસ્લિમોને બિનસાંપ્રદાયિક અને ટેક્નિકલ શિક્ષણ આપવા માટે એક પોલિસી તૈયાર કરશે.

તેમનું કહેવું હતું કે આ મુદ્દે એક સર્વસંમતિ સાધવાનો અમારો પ્રયાસ રહેશે. નેશનલ કમિશન ફોર માઇનોરિટી એજ્યુકેશનલ ઇન્સ્ટિટયૂશન્સ એક્ટને વધુ મજબૂત બનાવવા માટે તેમાં સુધારાનો પ્રયાસ પણ કરવામાં આવશે.


કપિલ સિબ્બલે કરેલી દરખાસ્તો

-ધોરણ ૧૨ માટે રાષ્ટ્રીયસ્તરે એકસમાન પરીક્ષા.

-ધોરણ ૧૦ના બોર્ડની પરીક્ષા વૈકલ્પિક બનાવવા.

-શૈક્ષણિક લોનના વ્યાજ પર સબસિડીની નવી યોજના

-૫૦૦૦ કોલેજો અને યુનિર્વિસટીઓને બ્રોડ બેન્ડ કનેક્ટિવિટી.

-શિક્ષકોના શિક્ષણ માટે એક નવી નીતિ તૈયાર કરવાની.

ડે ટુ ડે વર્ક અને દરરોજનું સાત કલાકનું વાચન જરૂર સફળતા અપાવે છે

રાજકોટની બી. જે. મોદી હાઇસ્કૂલની સ્વાતી કારિયા સમગ્ર બોર્ડમાં દસમા ક્રમે ઝળકી છે ત્યારે તે પણ મોટાભાઇના પગલે પગલે ડોકટર બનવા માંગે છે. ૯પ.૦૮ ટકા સાથે ૬પ૦માંથી ૬૧૮ માર્કસ મેળવનાર સ્વાતીને સંસ્કતમાં ૯૯ માર્કસ આવ્યા છે.

ડિલક્ષ ટોકીઝ પાસે દુકાન સંભાળતા જીતેન્દ્રભાઇ કારિયાની પુત્રી સ્વાતીને બોર્ડમાં સ્થાન મેળવવાની ધારણા હતી. દરરોજનું સતત સાતેક કલાકનું વાચન અને ડે ટુ ડેનું વર્ક સફળતા પાછળ દોરી જાય છે તેમ સ્વાતીએ ઉમેર્યું હતું. અભ્યાસની આત્મવિશ્વાસ પણ જરૂરી છે.

રણછોડદાસજી આશ્રમે દરરોજ દર્શન કરી અભ્યાસમાં લાગી જતી સ્વાતીએ પરિણામના દિવસે ગુરૂદેવ આગળ પોતાનું શીશ ઝૂકાવ્યું હતું. ગુરૂદેવમાં અપાર શ્રઘ્ધા ધરાવતી સ્વાતીની માતા રાજકોટ કોર્પો.ની શાળા નં.૧પમાં શિક્ષિકા છે.

માતા-પિતા તેમજ મોદી સ્કૂલના રશ્મિકાંત મોદી, વિમલ સર અને શિક્ષકો ઉપરાંત દાદા-દાદીના આશીર્વાદ અને સહકારથી બોર્ડમાં ઝળકી હોવાનું તેણીએ જણાવ્યું હતું. જો કે સ્વાતીને ‘સોશિયલ સ્ટડીઝ’માં ઓછા માર્કસ આવ્યાનો અફસોસ હતો. પેપર ખોલાવાની ઇરછા વ્યકત કરી હતી. ધો.૯માં ૯૪ ટકા સાથે સ્વાતી ઉત્તીર્ણ થઇ હતી, અત્રે એ ઉલ્લેખનીય છે કે મોદી સ્કૂલનું ધો.૧૦નું છેલ્લા છ વર્ષનું પરિણામ સો ટકા આવ્યું છે તેનો શ્રેય સ્વાતીને મળ્યો છે.
